This Privacy Policy describes how Goya Foods, Inc. together with its subsidiaries (collectively “Goya”, “we”, “our”, or “us”) will collect, access, use and disclose your Personal Information, including in relation to your use of Goya’s website at www.goya.com (the “Website”). This Privacy Policy does not apply to information collected on the Goya Webstore at https://shop.goya.com/ (the “Webstore”). The Webstore is distinct from Goya’s website and other information collected online or offline by Goya. For purposes of this Privacy Policy, “Personal Information” is information relating to an identified or identifiable individual. For purposes of this Privacy Policy, Personal Information does not include de-identified or aggregated information and, to the extent permitted by law, does not include publicly available information that is lawfully made available to the general public or information that is lawfully made available from government records.
Third Party Retailers. This Privacy Policy does not apply to third party retailers that collect Personal Information directly from you on their own platforms or websites in order to sell and distribute Goya products through such platforms or websites. Such retailers operate as separate and independent businesses and have their own practices and policies concerning the collection, use and sharing of personal information.
Exclusions. This Privacy Policy does not apply to (i) Personal Information collected when you apply for a job with Goya or (ii) Personal Information collected as an employee of Goya.
Goya collects certain information from you and your devices. By using the Website, ordering products or services, or otherwise providing Personal Information to Goya, you consent to Goya’s collection, access, use and sharing of the information as described in this Privacy Policy.

In addition, Goya will not disclose your Personal Information to third parties for their own direct marketing purposes without further notice to you. If you are entitled to any disclosure rights in your jurisdiction regarding our disclosure of your Personal Information to third parties for their own direct marketing purposes, this disclosure satisfies those requirements.
1. Opt-Out Preference Signals
We treat user-enabled global privacy controls (which may also be considered do not track preferences), such as a browser plug-in or privacy setting, device setting, or other mechanism, that communicate or signal your choice to opt-out of the sale of your Personal Information as a valid opt-out request.
2. Tracking Technologies and Targeted Advertising

Once we receive your request and verify your identity, we will disclose to you one or more of the following as requested:

The categories of sources from which we collected your Personal Information in the preceding twelve (12) months.
The business or commercial purposes for collecting your Personal Information in the preceding twelve (12) months.
The categories of other parties with whom we shared your Personal Information in the preceding twelve (12) months.
The specific pieces of Personal Information we collected about you in the preceding twelve (12) months.
You may only make a consumer request to know about or access your Personal Information twice within a twelve (12)-month period.
2. Right to Delete Your Personal Information
If you are a California consumer, you may have the right to request that Goya delete certain of your Personal Information that we have collected from you. However, this right to deletion does not apply to any of your Personal Information that is subject to an exception under the CCPA (as described below). Once we receive your request and verify your identity, we will delete your Personal Information in our records that is not subject to any of the CCPA exceptions.
CCPA Exceptions
We may deny your deletion request where your Personal Information is required for any of the following reasons, which we will identify in our response to you if we deny your request:
Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

3. Right to Opt-Out of the Sale of Your Personal Information; Right to Receive Information regarding Sale of Personal Information
If you are a California consumer, you may have the right to opt-out of the sale of your Personal Information.
If you are a California resident, you may have the right to request and receive certain information about our disclosure of your Personal Information to third parties for their own direct marketing purposes, and your choices with respect to such disclosures. 4. Right to Non-Discrimination
If you are a California consumer, you have a right to not receive discriminatory treatment for exercising your privacy rights. Goya will not discriminate against any California consumer who exercises any of the rights described above. Specifically, except as permitted by the CCPA, we will not deny you goods or services; charge you different prices or rates, including through granting discounts or other benefits, or imposing penalties; provide you with a different level of service or quality of goods or services; or suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

6. Submitting a Request Through Your Authorized Agent
If we receive your request from an authorized agent, we may ask for evidence that you have provided such agent with a power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. 7. How We Verify Your Request
We cannot fulfill your request to provide you with or delete your Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us.
Once you have provided the required information to Goya, we will confirm your identity by conducting an electronic search of our internal systems to ensure the information provided by you in your request matches what we have in our systems.
To verify your identity, we will ask that you provide the following information when you submit your request:
Your first and last name
Your email address
Your phone number
Depending on your type of request or the information requested by you, we may require additional information in order to verify your identity and fulfill your request. If we cannot successfully verify your identity, we will inform you of that fact.
We will respond to your request within forty-five (45) days. However, in certain circumstances, we may require additional time to process your request, as permitted by the CCPA or other applicable law. We will advise you within forty-five (45) days after receiving your request if such an extension is necessary and why it is needed. Any disclosures we provide will only cover the twelve (12)-month period preceding our receipt of your request. If we cannot fulfill your request, our response to you will also explain the reason why we cannot fulfill your request.
We do not charge a fee to process or respond to your consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
The Website may include links to other websites that we do not own or operate. We do not control and are not responsible for these sites or their content, products, services, or privacy policies or practices. These other sites may send their own cookies to your device, they may independently collect data or solicit personal information and may or may not have their own published privacy policies.
